Nevada Statutes Regarding Possession of an Illegal Drug, With Intent to Sell
Under the Nevada Revised Statute 453.322, possession, cultivation or manufacturing a controlled substance other than marijuana, with intent to sell or distribute is subject to category B felony charges and faces a minimum prison sentence of three years and may be a fine up to $100,000.
Adding the charge 'intent to sell' is a subjective decision on the part of the prosecutor, often determined by the amount of narcotics found in the suspect's possession or property at the time of the arrest. Even possession of a small amount of cocaine for personal use can include the additional trumped-up charge of 'intent to sell' if the prosecutor decides that, in his or her opinion, the illegal substance is more than one individual can reasonably be expected to possess for personal use.
Fighting felony charges requires experience and knowledge of the local prosecutors and judges involved in your case. Investigating any type of drug charges for an effective legal defense often involves looking beyond evidence on the surface. At the Oronoz Law Offices, we challenge everything in our aggressive efforts to prepare your case to win in trial.
